Unlike most federal suits, a suit against the IRS may be maintained in one of three different independent and vastly different courts: the United States Tax Court, United States District Court, and the United States Court of Federal Claims.
As such, three different sets of local rules, two different appellant jurisdictions and most importantly, three different sets of legal precedents govern tax litigation. In addition, depending on which court system is selected, a taxpayer may not even be suing the IRS and facing an IRS attorney; rather he may be suing the IRS and facing an attorney from the Department of Justice.
